Dear Homeowner,

Each Lot in the Cinnamon Creek neighborhood is granted certain rights and

responsibilities as laid out in the Declaration of Covenants, Conditions, Restrictions and

Easements encumbering the title to those Lots. However, what declaration encumbers

your specific property depends upon what part of the neighborhood you live in.

Cinnamon Creek was developed over the course of three phases. Each of those

phases is governed by its own declaration.

 

If you own one of the Lots from 2-209 in the Cinnamon Creek subdivision, your property is encumbered by the declaration recorded

on December 21, 1994, in Book 1136 at Pages 449-458 of the Miscellaneous Records

of the Register of Deeds of Douglas County, Nebraska (the “1994 Declaration”).

Lots 1 through 176 of the Cinnamon Creek 2nd Addition are encumbered by declaration dated

October 9, 1996, and recorded on October 15, 1996, in Book 1190, at Pages 631-641 of

the Miscellaneous Records of the Register of Deeds of Douglas County, Nebraska (the

“1996 Declaration”).

Lots 177 through 360 of the Cinnamon Creek 2nd Addition are

encumbered by the declaration dated September 24, 1998, and recorded on September

30, 1998, in Book 1265, at Pages 172-181 of the Miscellaneous Records of the Register

of Deeds of Douglas County, Nebraska (the “1998 Declaration”).

 

Functionally, the 1994 Declaration, 1996 Declaration, and the 1998 Declaration

work the same way. They all restrict the usage of our properties the same way, and they

all can be amended the same way. However, in the current configuration, we technically

have three separate sets of rules governing our neighborhood. The Cinnamon Creek

Neighborhood Association (the “HOA”) board is now proposing an amendment to the

declarations so every Lot in the neighborhood is governed by the same document.

  • The "Combined Covenant" at cinnamoncreek.50megs.com web site is a redlined version of the declaration currently

encumbering the Lots. Each of the redlines you see is a proposed change which will

have the effect of either (1) combining all the Lots under one set of rules, or (2)

removing outdated text from the declarations. You can also see a version of the current

declaration by visiting cinnamoncreek.50megs.com. That website has both the current

version of the declarations and the final proposed version for you to review.

Also enclosed is a ballot for the owners to fill out so they may vote regarding

whether they approve or disapprove of the proposal to consolidate the declarations.

Only one registered owner of each Lot is allowed to vote on this ballot. Renters do not

have the authority to cast a vote in this matter.

Please mail back your signed ballot by March 31, 2024. Any Lot which does

not submit their ballot by March 31, 2024 will be contacted in a door-to-door vote

collection effort. For this amendment to pass, at least 75% of each of the three phases

of the development will need to approve of the amendment. If the amendment fails for

any one of those three phases, it will fail for all three phases.
